Please note, in order to register for Maurice L. Britt Post 0123 Medal of Honor Classic, you must check the box in the registration

process which implies consent to the Participant Waiver of Liability & Photograph and Video Release.

 

Participant Waiver of Liability

The health and well-being of our members, sponsors, volunteers and staff across the country is a top priority for the Maurice L. Britt American Legion Post 0123 (hereafter “MLBAL”). To ensure the safety of all participants in the MLBAL Medal of Honor Golf Tournament (the “Tournament”, checking the box, I acknowledge and agree as follows:

1. I hereby acknowledge and agree that I am entering the Tournament voluntarily and am aware that by my participation there may be inherent risks to my health and well-being including, but not limited to, exposure to the COVID-19 virus.
2. I acknowledge that I have been made aware of enhanced safety protocols as may be published by Diamante Country Club and/or EventCaddy, have had the opportunity to review them and agree to abide by their provisions including, but not limited to, requirements for sanitization and physical distancing precautions, and I undertake to take due care to follow said protocols as a condition of my participation in the Tournament.
3. I understand that any risk to my health and well-being may result from the actions, omissions, or negligence of myself and others, including, but not limited to, MLBAL employees, volunteers, and participants. I voluntarily agree to assume all of the risks and accept sole responsibility for any injury to myself, including, but not limited to, personal injury, disability, death, illness, damage, loss, claim, liability, or expense of any kind, that I may experience or incur in connection with my participation.
4. I hereby release, covenant not to sue, discharge, and hold harmless MLBAL, its employees, volunteers, agents, and representatives, of and from any and all Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating to my participation. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of MLBAL, its employees, agents, volunteers and representatives, whether such damage, injury or illness, including but not limited to COVID-19 infection, occurs before, during or after my participation.
5. I agree to indemnify and hold harmless MLBAL and its employees, volunteers, agents, and representatives from and against all claims, losses, damages, costs, expenses, actions and other proceedings, made, sustained, brought, prosecuted, threatened to be brought or prosecuted, in any manner based upon, occasioned by or attributable to the negligence or willful acts or omissions of myself as a result of my participation and/or failure to properly follow any measures or protocols.
6. I have read and understand the Participant Waiver of Liability and consent to its application regarding my participation in the golf tournament.

I hereby grant permission to the rights of my image, likeness and sound of my voice as recorded on audio or video tape without payment or any other consideration.  I understand that my image may be edited, copied, exhibited, published or distributed and waive the right to inspect or approve the finished product wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of my image or recording.  I also understand that this material may be used in diverse educational settings within an unrestricted geographic area.  

Photograph and Video Release

Photographic, audio or video recordings may be used for the following purposes:

• tournament promotions
• event broadcasts
• informational presentations

By checking this box, I understand this permission signifies that photographic or video recordings of me may be electronically displayed via the Internet or in the public domain.

I will be consulted about the use of the photographs or video recording for any purpose other than those listed above.

There is no time limit on the validity of this release nor is there any geographic limitation on where these materials may be distributed.

This release applies to photographic, audio or video recordings collected as part of the sessions listed on this document only.

By cheking this box, I acknowledge that I have completely read and fully understand the above release and agree to be bound thereby. I hereby release any and all claims against any person or organization utilizing this material for the above purposes.
