PTB Golf Tournament Raffle

Official Rules

  1. NO CONTRIBUTION OR DONATION IS NECESSARY TO enter or win. VOID WHERE PROHIBITED BY LAW. ALL DISPUTES WILL BE RESOLVED SOLELY BY BINDING ARBITRATION AND ENTRANTS WAIVE THE ABILITY TO BRING CLAIMS IN A CLASS ACTION FORMAT. Promotion is offered only for contestants in the PTB Golf Tournament. Void where prohibited.

Introduction

  1. The PTB Golf Tournament Raffle (the “Promotion”) is sponsored by the Tampa Bay Maritime Scholarship Foundation (TBMSF) and the Tampa Port Ministries (TPM) (the “Charities”), both a 501(c)(3) tax-exempt organization with a principal place of business at 1309 Shoreline Dr, Tampa, Florida 33605. The mission of the TBMSF is to support through scholarships, graduating students from Jefferson High School and other public institutions looking to further their maritime education. The mission of the TPM is to meet the physical, social, and spiritual needs of seafarers and others who use the facilities of the Port of Tampa. Merchandise is either purchased by the Foundations or donated by third parties.
  2. Promotion consists of raffle drawings (each, a “Drawing”) that will be offered in conjunction with the PTB Golf Tournament, at the Eagles Golf Club on April 19, 2024.  The Promotion ends April 19, 2024. This Promotion is in conjunction with the PTB Golf Tournament 50/50 Raffle is governed by these Official Rules (the “Official Rules”).
  3. Raffle tickets (“Raffle Tickets”) are available on line at: Home - 10th Annual Port Tampa Bay & Partners Golf Tournament (eventcaddy.com) and also in person the day of the event up until all contestants have completed play and/or announcements are made to the cessation of sales. You must be present to win raffle prizes but you do not have to be present to win the 50/50.
  4. Raffle Tickets are valid only for the Drawings set forth in these Official Rules. Non-winning Raffle Tickets will not carry over to any other Promotions. Raffle Ticket donations are not tax deductible, and no refunds will be made, except as otherwise determined by the Foundation in its sole discretion.
  5. Each winner will be issued any Internal Revenue Service (“IRS”) tax forms or other required documentation and/or reporting forms for the ARV of the prize awarded if required and such winner is solely and exclusively responsible for all state, federal or local income taxes that may result from his/her/their acceptance of that prize. The Foundation is required by law to withhold and remit to the IRS on a winner’s behalf an amount equal to twenty-five percent (25%) of his/her/their prize awarded (the “Withholding Amount”) if the value of the prize exceeds $5,000 and such winner is a citizen or resident alien of the United States with a Social Security number (different rules as promulgated by the IRS apply for nonresident aliens and for resident aliens and citizens of the United States who do not have a Social Security number) or as otherwise required by law.

Eligibility

  1. To be eligible, you must be eighteen (18) years old or older and present in the drawing area
  2. Employees, associates, officers, directors, volunteers and agents of the Charities or any other entity directly involved in the development or administration of the event, and the members of their immediate families (defined as spouse, parents, siblings and children) and households are not eligible to enter or win. The term "household" includes all persons residing together (part-time or full-time) in a single residence, whether or not related.
  3. Promotion is not open to groups, clubs or organizations. Groups, clubs and organizations are prohibited from reproducing or distributing Promotion materials to their members without the Foundation’s prior express consent.

Prizes & Odds

  1. 50/50 Raffle Grand Prize (1): Cash or check in the amount of fifty percent (50%) of the Net Raffle Proceeds. Approximate Retail Value (“ARV”): $50.00 (Minimum);
  2. Raffle Prizes (>25): Random as per ticket drawing
  3. The odds of winning depend on the number of tickets distributed.

Prize Restrictions

  1. All prize details shall be at the Charities sole discretion.

Cash Prizes

  1. Cash prize will be paid to winner either by cash or check by the Charities and may be subject to withholding as described above or other withholding requirements under applicable law. Cash prize will not be paid to any other person or third party on behalf of any winner.

Merchandise

  1. Each prize does not include delivery nor include assembly or installation, if any is required.

All Prizes

  1. Any images of any prize/prize components in advertising are for illustrative purposes only; actual items awarded as prize/prize components may differ from such images. Entrants agree that Released Parties (below) expressly disclaim any and all liability in conjunction therewith.
  2. Noncash prizes are not redeemable for cash and may not be sold, bartered or auctioned. The right to receive any prize is personal to winner and is not transferable. Any prize or portion thereof not accepted by any winner is forfeited and no cash or substitute will be offered or permitted. Prizes may not be substituted except that the Foundation in its discretion may substitute a prize, or portion thereof, with a prize or portion of equal or greater value if it deems necessary. Any such changes will be announced.
  3. Each prize offered is provided “as is” with no warranty or guarantee either express or implied by Released Parties (below). Merchandise prizes or prize components (if any) carry no warranty other than that offered by manufacturers. Released Parties have neither made nor are responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition or fitness for a particular purpose. Other restrictions apply.
  4. Each winner assumes sole responsibility for all expenses and incidental costs associated with accepting or claiming any prize not expressly included in such prize description above, including without limitation, all federal, state and/or local taxes, including sales, use and income taxes (if any), any transportation to claim prize, fees and/or other items.

To Enter

  1. Raffle Tickets are available on the PTB Golf Tournament website and the day of the event up until announcement of cessation of sales.
    1. Raffle Sales Representatives (Day of the event Only): You may obtain Raffle Tickets from event Raffle representatives periodically circulating with hand-held distribution devices at Golf Course. Be sure to provide any Required Information when you complete your transaction (see below for information regarding the Suggested Minimum Contribution);
    2. Online Sales: You may purchase obtain Raffle Tickets at any time during the Promotion online at the Promotion Page (Home - 10th Annual Port Tampa Bay & Partners Golf Tournament (eventcaddy.com)) by following the instructions to complete the transaction (see below for Suggested Minimum Contribution) and provide any Required Information;
    3. NO CONTRIBUTION OR PURCHASE NECESSARY (Online): You may obtain Raffle Tickets at any time during the Promotion without a donation by visiting the Promotion Page and following the instructions to complete an official entry form or Raffle Ticket request and provide any Required Information; or

Regardless of method, raffle tickets will only be distributed as described above during the Promotion and during the event. All participants may be required to present a photo identification as a condition of obtaining Raffle Tickets. These are the only methods of entry. Entries will not be accepted via U.S. Mail, email, or any other method.

  1. The suggested minimum contribution (“Suggested Minimum Contribution”) for the Raffle Tickets will be displayed or posted where Raffle Tickets are available (online or in person). Raffle Ticket donations are not tax deductible. Making a contribution or donation will not improve your chances of winning.
  2. IMPORTANT: MESSAGE AND/OR DATA RATES MAY APPLY TO THE USE OF MOBILE PHONES/DEVICES TO PARTICIPATE IN THE RAFFLE. WIRELESS SERVICE MAY NOT BE AVAILABLE IN ALL AREAS. EACH WIRELESS CARRIER’S DATA RATE PLAN MAY VARY, AND YOU SHOULD CONTACT YOUR WIRELESS CARRIER FOR INFORMATION ON DATA RATE PLANS AND CHARGES RELATING TO YOUR PARTICIPATION IN THIS PROMOTION.
  3. All Raffle Ticket sales and requests must include a valid daytime phone number or email address if requested for the entrant and entrant remains solely responsible for notifying the Charities of changes in his/her/their contact information. Released parties as defined below are not responsible for voice or electronic communications that are undeliverable because of any form of call blocking, inability to leave a voice message, passive or, as to email, active filtering of any kind. In the event of a dispute as to the identity or eligibility of a winner based on an email address, the entry will be deemed made by the “Authorized Account Holder” of the email address used for entry. The Authorized Account Holder is the natural person who is assigned to the email address by the relevant Internet access provider, online service provider, or other organization responsible for assigning email addresses for the corresponding domain. In the event of a dispute as to the identity of any entrant, the potential winner agrees to furnish requested documentation confirming his/her/their status as the Authorized Account Holder.
  4. Participants who fail to provide any required information may be disqualified without further notification by the Charities. The Foundation is not responsible for Raffle Tickets that are lost, misdirected, stolen, damaged, garbled, distorted, truncated, incomplete, illegible, incorrect, altered, tampered with, counterfeit, unauthenticated, or late for any reason, and all such Raffle Tickets are void. The Foundation reserves the right in its sole discretion at any time to disqualify any Raffle Ticket that, or participant who, does not comply with these Official Rules in its sole discretion.
  5. Any use of robotic, repetitive, automatic, programmed, mechanical, script, macro, or any other automated means or similar entry methods or agents (including, but not limited to, contest-entry services or multiple or different email addresses or mobile devices, or the submission of false contact information under multiple or different email addresses, mobile devices, identities, registrations, accounts or logins) or any other devices or artifices to enter or encourage, directly or indirectly, false or fraudulent entries are prohibited and suspected or detected entry method violations may void some or all entries submitted by that entrant, in the Foundation‘s sole discretion.
  6. If you participate in the Promotion online, you agree that the information that you provide in connection with the Promotion may be used by the Charities in accordance with the Privacy Policy, which may be updated from time to time, and you acknowledge that you have read and accepted the Charities Privacy Policy.

Winning Ticket Selection & Announcement

  1. Raffle and 50/50 awards shall be made after completion of the golf course event and after contestants have a reason time to make their way back to the Eagles Golf Club, but no later than 5 PM the day of the event.
  2. Each Winning Ticket Number will be announced over the Public Address System within the Golf Club

Winner Requirements

  1. Each potential winner must complete each of the following steps to claim his/her/their prize, as described below:
    1. Notification: Notify the announcer of possession of the Winning Raffle Ticket within a reasonable time.
    2. Presentation: Present the original Winning Raffle Ticket to the announcer or his designee’

Notification

  1. Winners are exclusively responsible for providing the Charities with current and functioning contact information, if necessary. Released parties shall not be responsible for any undeliverable or misdelivered communications in response to the Notification.

Presentation

  1. The original Winning Raffle Ticket is the only valid receipt for claiming a prize. Subject to authentication below, the date on which the Charities receive the original Winning Raffle Ticket from any potential winner shall hereinafter referred to as the "Delivery Date").
  2. The Foundation will verify that such Raffle Ticket bears a winning ticket number and is the authentic Winning Raffle Ticket for the relevant Drawing.

Verification

  1. The Charities may require any potential winner to provide or present any or all of the following materials (collectively, the “Verification Paperwork”) if required by law:
    1. Potential winner’s complete mailing address (street addresses only; no P.O. Boxes will be accepted) (“Mailing Address”), telephone number and/or other contact information;
    2. Notarized affidavit or signed declaration of eligibility and liability and publicity release (where legal);
    3. Two (2) forms of identification satisfying the requirements for completion of the W-9, including at least one (1) valid government-issued photo identification; and
    4. Completed W-9 tax form (if required) and/or other legal documents.
  2. Each winner, if required, must furnish all Verification Paperwork to the Charities within seven (7) days of the Delivery Date as a condition of receiving his/her/their prize (the “Verification” requirements). The Charities, in its sole discretion, may allow for transmission of some or all Verification Paperwork via fax or email. Any transportation or other expenses needed to satisfy the notification, Presentation and/or Verification requirements shall be such winner's sole responsibility and will not be furnished or paid for by the Foundation.
  3. Released Parties (as defined below) are not responsible for lost or stolen raffle tickets or Raffle Tickets redeemed in error by their agents.

Fulfillment

  1. Upon timely and complete compliance of a winner’s timely and complete compliance with all Notification, Presentation and Verification requirements and procedures above (together, “Confirmation”), that potential winner will be deemed a winner.
    1. Cash Prizes: Charities shall fulfill any cash prize, less the Withholding Amount, if any, to such winner either by cash or check payable to the winner and, if requested, mailed to the Mailing Address or, for security purposes, via wire transfer to a confirmed bank account provided by such winner;
    2. Noncash prizes: Charities, if necessary for the convenience of either party, will provide noncash prize winners with instructions on claiming or receiving their prizes.
  2. Each winner remains responsible for furnishing Charities with an accurate and current Mailing Address and/or, if applicable, bank account information and wiring instructions.

Disqualification

  1. The Charities will not be required to attempt to notify or locate the holder of any Winning Raffle Ticket in any manner other than the Announcement methods above. Released Parties will not be responsible for the failure of any person to timely contact the Charities for any Winning Ticket Number or for otherwise being unaware that he/she/they may possess a Winning Raffle Ticket, or for otherwise failing to fully and timely comply with all Notification, Presentation and Verification requirements, procedures and/or deadlines above. Any purported Winning Raffle Tickets presented to the Foundation outside the Claim Period or otherwise not in strict compliance with these Official Rules shall be null and void.
  2. Disqualification Procedures: If any potential raffle winner (a) fails to fully satisfy any of the Notification, Presentation and Verification requirements, procedures and/or deadlines above, (b) fails otherwise to satisfy any eligibility or verification requirement herein, (c) declines to accept the prize, or (d) is otherwise determined to be ineligible, the Charities at its discretion may disqualify that individual and he/she/they will forfeit such prize, in which case the Charities will select an alternate Winning Ticket Number by random drawing from the Raffle Tickets distributed during this Promotion only as soon as reasonably practicable after such disqualification. The requirements, procedures and/or deadlines shall apply to any potential alternate winners, who shall be subject to all eligibility requirements and restrictions of these Official Rules. The Charities will make a reasonable and timely attempt to verify an alternate winner for any prize. If the Charities are unable to verify an alternate winner for any prize after five (5) attempts, no further attempts will be made for such prize, and it will revert to the Charities.
  3. The Charities may, in their individual discretion, post the verified winners’ names on the Promotion Page and/or any of their websites, and on or in any of their social media pages or channels and broadcast it on any of their stations. Except as provided in these Official Rules or otherwise required by law, the Charities are not responsible for entering any correspondence or discussion regarding any Promotion results.

Publicity Release

  1. By accepting a prize, each winner agrees to award the Charities the right to publicize his/her/their name, photographs (including the use and appearance of his/her/their photograph on its websites), likeness, biographical information, email address, voice and details of winning for purposes of this and future promotions without further compensation, except where prohibited.

Limitation of Liability

  1. By entering, accepting a prize and/or otherwise participating in the event, you agree that the Charities and any other company involved in any way with the Promotion, their respective parent companies, affiliates, subsidiaries, distributors, advertising and promotion agencies, prize suppliers, franchisees, and all of their respective officers, directors, agents, employees and related persons (collectively, the “Released Parties”) (a) are not responsible for mechanical, technical, electronic, communications, telephone, computer, hardware or software errors, malfunctions or failures of any kind, including but not limited to: failed, incomplete, misdirected, corrupted, garbled or delayed transmissions, telephone connections, traffic congestion on telephone lines, the Internet or at any website; or disconnected, interrupted, or unavailable network, server, or other connections; or late, lost, undeliverable, damaged or stolen mail; or other errors of any kind, whether human, mechanical, or electronic; or entries or requests that for any reason are not properly submitted or received by the Foundation by any deadline stated above; (b) are not responsible for any incorrect or inaccurate information, whether caused by entrants or other participants, printing, typographical or other errors or by any of the equipment or programming associated with or utilized in the Promotion or in the printing of this offer, administration of this Promotion, or in the selection or announcement of any winner or prize, or otherwise in any Promotion-related materials; (c) are not responsible for any injury or damage to any computer, tablet, smartphone, modem or other device as a result of participation in this Promotion or downloading of any software or materials; (d) are not responsible for unauthorized human intervention in any part of the Promotion; (e) are not responsible for any unauthorized third-party use of any entry materials; (f) are not responsible for the inability to select any winner because of postal failure, equipment failure, or data storage failure; (g) are not responsible for any printing, typographical, technical, computer, network or human error that may occur in the administration of the Promotion, the distribution of Raffle Tickets, the selection of any Winning Raffle Number or the determination of any Winning Raffle Ticket, winner, prize and/or otherwise in any Promotion-related materials; and (h) are released from any and all alleged, existing, or future actions, claims, and/or liabilities of whatever nature including, but not limited to, personal injury, bodily injury (including, without limitation, wrongful death and disability), property damage, and expense (including, without limitation, reasonable attorneys’ fees) and loss or damage of any other kind, arising in whole or in part directly or indirectly, from participating in the Promotion (in whole or in part), the use (including modification, adaptation, and reproduction) of entry materials during or after the Promotion, and the delivery, acceptance, possession, redemption, use, misuse, loss, or misdirection of any prize.
  2. RELEASED PARTIES EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND (WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE), INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. RELEASED PARTIES SHALL NOT BE LIABLE OR RESPONSIBLE FOR THOSE GUARANTEES OR WARRANTIES MADE OR OFFERED BY ADVERTISERS, PARTNERS, MANUFACTURERS OR SUPPLIERS, INCLUDING THOSE RELATED TO ANY PRIZE. UNDER NO CIRCUMSTANCES SHALL RELEASED PARTIES BE HELD RESPONSIBLE OR LIABLE FOR YOUR USE OF THE INFORMATION AND/OR PRODUCTS PROVIDED AND/OR MADE AVAILABLE THROUGH THE PROMOTION OR FOR ERRORS OR ANOMALIES RESULTING IN THE UNINTENDED OR ERRONEOUS PARTICIPATION, AWARD OF ANY PRIZE OR OTHER BENEFITS UNDER THESE OFFICIAL RULES. RELEASED PARTIES OFFER NO ASSURANCES, GUARANTEES OR WARRANTIES THAT THE PROMOTION PAGE OR RELATED WEBSITES OR MOBILE PLATFORMS, OR ANY OF THEIR RESPECTIVE FEATURES OR FUNCTIONALITIES, WILL BE UNINTERRUPTED OR ERROR-FREE AND DO NOT GUARANTEE THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE PROMOTION.
  3. BY PARTICIPATING IN THE PROMOTION, YOU AGREE TO RELEASE, DEFEND, INDEMNIFY AND HOLD RELEASED PARTIES HARMLESS FROM ALL ALLEGED, EXISTING, OR FUTURE ACTIONS, CLAIMS, AND/OR LIABILITIES OF WHATEVER NATURE THAT MAY ARISE IN CONNECTION WITH, OR RELATE IN ANY WAY TO, EXPOSURE TO OR CONTRACTION OF COVID-19 (AS DEFINED BY THE WORLD HEALTH ORGANIZATION AND ANY OF THE STRAINS, VARIANTS OR MUTATIONS THEREOF) OR OTHER COMMUNICABLE AND/OR INFECTIOUS DISEASES, VIRUSES, BACTERIA OR ILLNESSES OR THE CAUSES THEREOF (COLLECTIVELY, “COMMUNICABLE DISEASE”) RELATED TO YOUR PARTICIPATION IN THE EVENT, ACCEPTANCE OF ANY PRIZE AND/OR DURING YOUR PARTICIPATION IN ANY RELATED ACTIVITIES ARRANGED, PROMOTED AND/OR SPONSORED BY THE RELEASED PARTIES, INCLUDING, WITHOUT LIMITATION, THOSE CLAIMS THAT ARISE AS A RESULT OF: (A) THE NEGLIGENCE OF ANY OF THE RELEASED PARTIES AND/OR (B) THE INHERENT RISKS ASSOCIATED WITH VISITING ANY VENUE, DURING ANY COMMUNICABLE DISEASE EPIDEMIC OR PANDEMIC, INCLUDING THE COVID-19 PANDEMIC.
  4. BY ENTERING, ACCEPTING A PRIZE AND/OR OTHERWISE PARTICIPATING IN THE PROMOTION, YOU FURTHER AGREE THAT (A) ALL DISPUTES, CLAIMS, AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE EVENT, OR ANY PRIZE AWARDED, SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (B) ALL CLAIMS, JUDGMENTS AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, INCLUDING COSTS ASSOCIATED WITH ENTERING THE EVENT, BUT IN NO EVENT ATTORNEYS' FEES; AND (C) UNDER NO CIRCUMSTANCES WILL YOU BE PERMITTED TO OBTAIN ANY AWARD FOR, AND YOU HEREBY WAIVE ALL RIGHTS TO CLAIM, ANY DAMAGES WHATSOEVER, INCLUDING DIRECT, INDIRECT, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES AND ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED AND ANY DAMAGES OTHER THAN ACTUAL OUT-OF-POCKET COSTS DESCRIBED ABOVE.
  5. SOME STATES DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES AND THEREFORE THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU IN WHOLE OR IN PART.

Miscellaneous

  1. The Charities reserve the right to cancel, suspend or terminate this event, or part thereof, if the Charities determines, in their sole discretion, that the security, administration, fairness and/or operation of the event has been corrupted or impaired by any non-authorized intervention, network failure, information storage failure, telecommunications failure, regularly scheduled maintenance, malfunction, or any other cause beyond the Charities control. In such an event, the Charities will post notice of same at the website and select the winners at random from all non-suspect entries received prior to the suspension, cancellation or termination of the event or in such other manner as the Charities, in its sole discretion, deems fair and appropriate under the circumstances.
  2. Note: Without limiting the generality of the foregoing, the Charities reserves the right, in its sole and absolute discretion, to terminate or suspend all or part of this event in the event that (a) its ability to conduct the event or any portion thereof is restricted or prohibited by any federal, state and/or local governing or regulatory body or agency, or by law or regulation; (b) any raffle is cancelled, postponed, or suspended by any third party as a result of any decision, decree or recommendation of any federal, state and/or local governing or regulatory body or agency, including any public health authorities; (c) that any public health authority discourages or recommends against attendance at or participation in any raffle; or (d) the Charities reasonably concludes in its sole discretion that the Event cannot be offered in a manner that is sufficiently safe to the relevant participants, employees or affected general public; whether any of the foregoing arise out of or result from new, ongoing or re-emerging occurrence in connection with COVID-19 (as defined by the World Health Organization and any of the strains, variants or mutations thereof), restrictions, “stay at home” government orders, guidelines or advisories, health crisis, or other causes outside of the Charities control. For the avoidance of doubt, the Charities failure or inability to award any prize offered, or otherwise to otherwise comply with any provision of these Official Rules as a result of the foregoing or of act of God, hurricane, earthquake, fire, volcanoes, war, riot, act of terrorism (domestic or otherwise), act of public enemies, actions of governmental authorities, restraints of public authority, or any similar or dissimilar occurrence or anything else beyond the Charities control (excepting compliance with applicable codes and regulations) or other force majeure event that makes awarding any prize offered in this event impracticable, inadvisable, impossible or illegal or that otherwise materially affects the Charities ability to provide any prize will not be considered a breach of these Official Rules and Charities will have the right in its sole discretion to cancel or rescind the Event as a whole and, if applicable, extend the relevant deadline as set forth above.
  3. The Charities reserves the right to disqualify any individual from further participation in the Promotion if the Foundation concludes, in its sole discretion, that such person (a) has attempted to tamper with any entry or selection process or other any operation of the Promotion, (b) has repeatedly disregarded or has attempted to circumvent these Official Rules, or (c) has acted towards Charities or any other entrant or other participant in an unfair, inequitable, deliberately annoying, threatening, disrupting or harassing manner. Tampering includes attempting to enter more than the number of times permitted herein, including by using any prohibited device or method. Any failure by the Charities to enforce any of these Official Rules shall not constitute a waiver of such Official Rules.
  4. ANY ATTEMPT BY ANY INDIVIDUAL TO DEFRAUD, TAMPER WITH, OR DELIBERATELY UNDERMINE, THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS AND THE Charities RESERVES THE RIGHT TO PURSUE ANY AVAILABLE DAMAGES OR REMEDIES AGAINST SUCH INDIVIDUAL AND/OR REFER SUCH MATTERS TO LAW ENFORCEMENT FOR PROSECUTION TO THE FULLEST EXTENT PERMITTED BY LAW.
  5. All activity arising out of and relating to the Promotion, including any reference to the status of any Raffle Ticket as a “Winning Raffle Ticket” or any person as a “winner” is subject to verification and/or auditing for compliance with the Official Rules. If the Charities determines, in its sole discretion, that verification or auditing activity evidence non-compliance of any entrant and/or Raffle Ticket with the Official Rules, the Charities reserves the right to disqualify such entrant and/or Raffle Ticket from the Promotion and any prize at any time.
  6. The Foundation reserves the right to correct typographical, printing or clerical errors in any Promotion-related materials. No more than the stated number of prizes will be awarded. If production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, the Charities reserves the right to award only the stated number of prizes by a random drawing from among all legitimate, un-awarded, eligible prize claims.
  7. In the event of any discrepancy or inconsistency between any terms or conditions of these Official Rules and any disclosures or other statements contained in any other Promotion-related materials, including but not limited to the Raffle Tickets, 50/50 and other entry materials, or point of sale, television, print, mobile or online advertising, the terms and conditions of these Official Rules shall prevail, govern and control. If any provision of these Official Rules is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

Entities & Trademarks

  1. PTB Golf Tournament Marks and logos are the property of PTB and the Charities.  Any third-party trademarks mentioned herein are the property of their respective trademark owners and the use or mention of any such third-party trademarks in these Official Rules or in the Promotion is solely for descriptive purposes and shall in no way imply an endorsement or sponsorship of the Promotion or of the Charities.  Any questions or complaints about this Promotion must be directed to the Charities and not PTB.

Disputes

  1. Except where prohibited by law, by participating in the Promotion, you expressly agree that (a) all disputes and causes of action arising out of or connected with the Promotion or any prize shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association (“AAA”) in accordance with its Commercial Arbitration Rules in Hillsborough County, Florida; and (b) judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.
  2. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrants or other participants or Released Parties in connection with the Promotion, shall be governed by Florida law, without giving effect to any choice of law rules that would cause the application of the laws of any jurisdiction other than Florida.
  3. By entering, accepting a prize and/or otherwise participating in the Promotion, you expressly agree that any legal proceedings not subject to arbitration and arising out of or relating in any way to this Promotion or these Official Rules shall be brought only in the federal or state courts located in Hillsborough County, Florida, and you consent to the mandatory and exclusive jurisdiction in such courts with respect to any such legal proceedings.
